The scope of the Charter of Fundamental Rights of the European Union, according to the jurisprudence of the CJEU based on the treaty of Lisbon

The article presents the Charter of Fundamental Rights of the European Union as a legal instrument of protection and guarantee of civil rights, followed by an analysis of art. 51 of the Charter, that will be extended by an examination of the jurisprudence of the Court of Justice of the European Union (CJEU). The analysis will consider the applicability of art. 51, emphasizing on the idea that it is recognized "only insofar as they implement Union law", a phrase that has generated a series of debates in relation to the idea of "promoting" the rights provided for in art. 51 para. 1 and the limits of the competence of the European Union, as established in art. 51 para 2. The article will also consider the links of the Charter with other international instruments on human rights, the European Convention on Human Rights (ECHR), examining the relationship between the two, but also the issue of interpreting the rights provided for in the Charter in contrast to similar or identical rights provided for in the European Convention on Human Rights. In relation to the case law of the CJEU, we will analyze some cases that are relevant to the topic under discussion, such as the joined cases C-8/15 P to C-10/15 P (CJEU, 2016), which capture the way in which the Charter applies to the institutions, offices and agencies of the European Union, case C-617/10 (CJEU, 2013), which will clarify the notion of "implementation of European Union law", but also the joined cases C-569/16 and C-570/16 (CJEU, 2018a) together with case C-684/16 (CJEU, 2018b), which also require some discussions, as they raise issues related to the scope of the Charter.
