Normative Acts Subordinate to The Law

In a society under permanent development, where the technique and the technology advance at a fast pace, there are many situations in which the so-called legislative vacuums occur. The Romanian legislation is not immune to such situations, and when they occur, the best solutions are sought to cover such issues. Also, when a new law is about to be promulgated or it has even been promulgated, there are situations when certain articles of the Constitution are violated, and for the regulation of such situations the Constitutional Court is resorted to. In this paper, the normative acts subordinated to the law will be analyzed. The analysis includes the classification of normative acts based on their legal value and issuing body, highlighting the hierarchical structure within the Romanian legal system. Beginning with the Constitution as the supreme law, the study examines the role of organic laws, ordinary laws, government ordinances, and government decisions. Normative acts issued by central and local authorities are explored in terms of their legal binding force on both individuals and entities, as well as their role in enforcing superior laws. This paper also discusses the importance of judicial oversight, specifically through administrative litigation, to ensure that normative acts comply with higher laws. By emphasizing the interdependence of these legal instruments, the study demonstrates how their proper hierarchy and application safeguard democratic principles and protect individual rights. In conclusion, understanding the structure of normative acts is essential for maintaining legal stability and addressing legislative gaps efficiently in a constantly evolving society.
